  • Terms and Conditions of the MyMower
     

    §1. Definitions

    1. Portal – The MyMower website, software, and ticketing system, as understood under the provisions of the Copyright Act, operated by MyMower and distributed under the name "MyMower." It is available on the Internet at the domains https://www.mymower.pl and https://www.mymower.eu. The Portal is intended for Clients and serves to facilitate the reservation of repairs by Clients for the purpose of concluding Service contracts with Service Providers.
    2. Client – A natural person making repair reservations for purposes unrelated to their business or professional activities, intending to use the Services offered by Service Providers.
    3. Service Provider – A garden equipment workshop using the ticketing system in connection with its business or professional activities and holding an account within the ticketing system.
    4. User - Customer
    5. Service – Services offered through the Portal by Service Providers, particularly in the field of garden equipment repair and related topics.
    6. Reservation – The act of reserving a Service by the Client through the Portal.
    7. MyMower – A brand of Bike Services Sp. z o.o., headquartered in Warsaw, ul. Batalionu AK Karpaty 5A/23, registered in the National Court Register (KRS) under the number 0000980730, REGON 522515651, and NIP 5213975544. It acts as the administrator and holds copyright to the Portal.

    §2. Scope of MyMower's Services

    1. MyMower provides Clients access to a portal that facilitates contact between Clients and Service Providers for concluding Service contracts. Through the Portal, Clients can make Service Reservations. The Portal is available online at https://mymower.pl.
    2. MyMower solely provides the Portal as a platform for establishing contact and concluding Service agreements. MyMower is not a party to these agreements and assumes no responsibility for the proper execution of the contracts.
    3. MyMower will strive to ensure the proper availability of the Portal and to quickly address any issues caused by its malfunction. Clients are not entitled to any claims regarding uninterrupted and continuous availability of the Portal, nor for its temporary suspension.

    §3. Customer

    1. A Customer can only be an individual who is at least 16 years old and has at least limited legal capacity. For minors, consent from a legal representative is required to use the Portal.
    2. The Customer gains access to the Portal’s functionalities and content without the need for logging in.
    3. By making a Booking, the Customer accepts the Terms and Conditions.
    4. By making a Booking, the Customer consents to the processing of their personal data provided during the Booking process.
    5. By making a Booking and selecting a specific option, the Customer agrees to receive notifications related to the use and functioning of the Portal via the Portal or directly from MyMower, particularly regarding the conclusion of an agreement with a Service Provider (e.g., confirmation or cancellation of a Booking). All notifications specified in the Terms and Conditions will be sent to the email address provided by the Customer during the Booking process. The Customer may also receive notifications via SMS to the phone number provided.
    6. The Customer voluntarily provides complete, truthful personal data and other required information during the Booking process. The Customer has the right to review and update this information without any request from MyMower. The Customer's personal data is included in the Administrator's database – Bike Services Sp. z o.o. – and the Customer has the right to access, correct, and restrict the processing of their data under the applicable legal regulations. The Customer also has the right to lodge a complaint with the supervisory authority if they believe the processing of their personal data violates the General Data Protection Regulation (GDPR) of April 27, 2016. The Customer’s personal data will be stored in a manner that ensures confidentiality, integrity, and availability in accordance with the law.
    7. All data and information provided by the Customer are submitted voluntarily. By entering data into the Portal, the Customer declares that they are authorized to provide such information and that their actions do not violate the rights of third parties. All information and data provided by the Customer on the Portal must be accurate. MyMower operates in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (referred to as "GDPR").
    8. The Customer agrees that the personal data and other information provided by them on the Portal will be accessible to Service Providers, MyMower, and its cooperating entities.
    9. The Customer consents to being contacted directly by Service Providers via the email address or phone number provided during the Booking process.
    10. The Customer is obliged to use the Portal only in accordance with its intended purpose. The Customer is prohibited from undertaking any actions that disrupt the functioning of the Portal. The Customer must not alter, bypass, or breach the Portal’s security systems, nor negatively impact the Portal by causing damage or overloading it, either independently or with the help of third parties.
    11. It is forbidden to post information on the Portal that violates the law or good morals. It is also prohibited to upload photos (if such functionality is available) that are unlawful, pornographic, or contrary to good morals. In case of a violation of this provision, MyMower has the right to remove the data or photos, temporarily block access, or delete the Customer’s data.
    12. The Customer is not allowed to copy, modify, distribute, or reproduce the entirety or parts of the Portal.
    13. The Customer may not allow third parties to access the Application. The Customer is solely responsible for the confidentiality and security of his Account, who is obliged to immediately inform BikeService about unauthorized use of his Account by third parties.
    14. The Customer is responsible for their actions related to the use of the Portal. Any violation of the law by the Customer while using the Portal releases MyMower from any liability to third parties. The Customer is obliged to compensate MyMower for any damage and costs incurred by MyMower as a result of the Customer’s violation of the law, the rules for using the Portal, or the Terms and Conditions.
    15. The Customer is required to promptly inform MyMower if third parties make claims related to the Customer’s violation of the law.
    16. The Customer may not process or use the personal data of other Users that is made available to them while using the Portal.
    17. The Customer has the right to permanently delete their personal data from the MyMower database at any time by making an explicit request via email to MyMower at

    §4. Customer Service Booking

    1. Through the Portal, the Customer can make a Service Booking. The Service Booking is automatically confirmed by the Service Provider via the notification system. The Customer receives a notification confirming the Booking.
    2. By making a Service Booking and having it confirmed by the Service Provider, a contract is concluded between the Customer and the Service Provider, which is governed by the applicable legal provisions, subject to the Customer's right to cancel the Booking. If the validity of the contract depends on meeting specific legal requirements, such as requiring the contract to be in writing or another special form, both the Customer and the Service Provider may demand the execution of the contract after the Service Provider confirms the Booking, subject to the Customer's right to cancel the Booking.
    3. The Service Booking may be canceled if the Customer fails to deliver the equipment to the service location or voluntarily decides to forgo the repair. Cancellation of the Booking under the conditions set by the Service Provider is equivalent to the Customer's withdrawal from the contract, the effects of which are governed by the applicable legal provisions.
    4. The Customer is obliged to make payment for the Service directly to the Service Provider under the terms specified by the Service Provider for the given Service.

    §5. Authority and responsibility of MyMower

    1. In the event that any claims are directed to MyMower or a request for the disclosure of Client data is made by authorized bodies or by an entity intending to pursue claims, MyMower is entitled to examine the facts and, if necessary, secure and provide the Client's data and other information posted on the Portal that are required to address and secure potential claims or fulfill such requests. All actions undertaken by MyMower will be performed in compliance with applicable legal provisions.
    2. The shaping of the content of the Portal is the exclusive right of MyMower. In particular, MyMower is entitled to modify or delete the content and features of the Portal, as well as transfer the rights to the Portal, along with the Client database, to a third party, while respecting the rules arising from GDPR.
    3. MyMower shall not be held liable for:
      1. interruptions in the operation of the Portal,
      2. the functioning of IT systems and telecommunications networks when Users make Reservations via the Portal,
      3. technical issues or difficulties related to the operation of computer or telecommunications equipment that hinder or prevent the use of the Portal or the services offered through it,
      4. the authenticity, reliability, accuracy, and completeness of data and information posted on the Portal by Users and shared between Users via the Portal,
      5. damages caused by Users in connection with the operation of the Portal or their activities within it, including breaches of the Terms and Conditions, unauthorized use of data provided via the Portal, submission of false, incomplete, or outdated data and information, or failure to update such data,
      6. damages caused by Users in connection with improper performance or non-performance of agreements concluded via the Portal,
      7. damages caused by Users through the violation of third-party rights,
      8. damages caused by third parties,
      9. damages related to the sale and provision of Services via the Portal, particularly Services performed improperly, without adhering to required standards, in violation of legal provisions, or lacking the advertised properties,
      10. damages arising from the lack of Users' capacity to enter into agreements via the Portal and from Users' insolvency.
    4. MyMower is liable to Clients only for damages incurred by them as a result of using the Portal, which have arisen solely due to MyMower’s intentional fault.
    5. MyMower is entitled to partially or completely suspend the operation of the Portal to carry out repairs or upgrades without the need to notify Clients in advance. In the event of a complete suspension of the Portal’s operation, an appropriate announcement will be published via MyMower’s social media channels.
    6. MyMower is entitled to make the Portal available to third parties, including granting access to Client data, to ensure the proper functioning of the Portal, its maintenance, and compliance with the Terms and Conditions.
    7. MyMower is entitled to entrust the administration of personal data provided on the Portal to a third party.
    8. MyMower is entitled to transfer all or part of its rights and obligations related to the Portal without requiring prior consent from Clients.
    9. MyMower is entitled to publish the number of Clients.

    §6. Complaints

    1. Irregularities Irregularities in the operation of the Portal may be advertised by Customers by notifying MyMower or persons acting on its behalf accordingly.

    3. The complaint will be considered within 14 days of receipt. In cases of complexity or where it is not possible to consider the complaint within the aforementioned period for reasons not attributable to MyMower, MyMower reserves the right to extend the time limit for the consideration of the complaint.
    4. MyMower reserves the right to request information or clarification from the complainant if this is required for the recognition of the complaint. Explanations or information should be provided by the Service Provider within 7 days. If this time limit is not observed, MyMower is entitled to leave the complaint unprocessed.
    5. MyMower's decision on the complaint is final and cannot be appealed.

    §7. Technical measures

    1. In order to use the Portal, it is necessary to have equipment that allows access to the Internet, e-mail and a web browser. The use of MyMower services via the Portal requires an active Internet connection. The use of the Portal on a mobile device requires a functioning mobile device. The customer is responsible for ensuring that the technical requirements of the mobile device, its configuration, software updates and Internet access are met. The costs of purchasing a mobile device, other devices which allow access to the Internet and the costs of connection to the Internet shall be borne entirely by the customer.
    2. MyMower uses ‘cookies’ to collect information related to the use of the Portal. Cookies are text files that are stored on the hard drive of the computers of visitors to the Portal in order to store information and data relating to the use of the Portal. If cookies are not enabled, this may cause irregularities or difficulties in the functioning of the Portal.

    §8. Personal data and privacy policy

    1. The Administrator of the Customers' personal data, to the extent in which they are necessary to make Reservations on the Portal, is Bike Services Sp. z o.o. with its registered office in Warsaw, ul. Batalionu AK Karpaty 5A/23, registered in the National Court Register under the KRS number 0000980730, REGON number 522515651, and NIP number 5213975544, which is the administrator and holds the copyrights to the application and the Portal.
    2. The data are processed by MyMower for the purpose of ensuring the proper functioning of the Portal and the performance of its function of enabling contact between the Customer and the Service Provider and concluding agreements for the provision of Services. The provision of data is voluntary, but is necessary for the use of the Portal.
    3. The Customer has the right to access the content of his/her data and the right to correct and delete it.
    4. MyMower does not use or store personal data and other data and information provided by Customers, for commercial and marketing purposes, nor does it sell such data to third parties.
    5. Access to the personal data provided by Customers on the Portal will be obtained by the Service Providers whose Services the Customer decides to use. Access to the personal data provided by Clients in the public Profile is available to all Internet users, of which the Client is aware.

    §9. Final Provisions

    1. MyMower reserves the right to amend the Terms and Conditions. Changes will be published in the form of updated content on the website https://www.mymower.pl.
    2. The new wording of the Terms and Conditions is effective from the date of publishing the content on this website.
    3. The Customer may not accept the changes to the Terms and Conditions by requesting the deletion of data within 7 days. If the data is not deleted, it is assumed that the Customer has accepted the changes.
    4. MyMower stipulates that the Portal and all texts and graphic elements placed by MyMower on the Portal are subject to its copyright or licence rights.
    5. These Regulations are subject to Polish law.
